BPCA: HSE’s proposed UK chemical/biocide reforms aim to cut duplication and fees

BPCA reported on 19 February 2026 (updated 27 February 2026) that after consultation HSE set out post-Brexit chemical-regulation reforms, and DWP tabled draft Chemicals (Health and Safety) (Amendment, Consequential and Transitional Provision) Regulations 2026. BPCA says several of its proposals were taken up, including recognition of EU biocide approvals and lower administrative burdens.

Main points

  • GB BPR: a path to recognise EU biocide approvals to cut duplication; HSE estimates substance authorisation fees could fall by up to about 97% (for example from about £160,000 to £4,800) and product fees by about 96–99%.
  • Expiry dates would move toward a risk-based call-in system (further consultation needed); expiry of 173 substances would be postponed by five years (to 31 July 2031 in the draft) to allow new rules to be built.
  • GB CLP: routine supplier notifications to HSE would be removed; information must still be produced on request. The draft is secondary legislation needing approval by both Houses of Parliament.
  • BPCA chief executive Rosina Robson is quoted: the reforms aim to protect the sector’s toolkit and open a path to product innovation in Great Britain. These are UK rules and do not apply in Vietnam.
