Circular 16/2024/TT-BYT: 16 groups of insecticide and disinfectant products now have HS codes

The Ministry of Health issued Circular 16/2024/TT-BYT on 30 September 2024, signed by Deputy Minister Nguyen Thi Lien Huong, effective 15 November 2024. It issues the list and the rules for applying HS codes to household and public-health insecticide and disinfectant products, and replaces Circular 09/2018/TT-BYT.

Main points

  • Article 2 issues the list against the export and import goods list in Circular 31/2022/TT-BTC of 8 June 2022 of the Ministry of Finance. The annex has 16 groups, from coils, impregnated mats, vaporising liquids, aerosols, powders, gels, creams, paints and baits, products for use on people, impregnated nets, curtains, hammocks, cloth and paper, spray products and larvicides (including products containing Bacillus thuringiensis israelensis), to hand, body, surface and household-water disinfectants and products for aircraft.
  • Article 3: goods in the list are managed under Decree 91/2016/NĐ-CP. If classification and the HS code do not agree, the code is set under customs law. A product not yet in the list is also coded under customs law. After clearance, the exporter or importer sends a written note to the Ministry of Health (the Health Environment Administration) so the ministry can work with the Ministry of Finance on an update.
  • Article 5: effect from 15 November 2024. Circular 09/2018/TT-BYT of 27 April 2018 ceases on the same day. Article 6 assigns implementation to the Health Environment Administration, units of the ministry, provincial health departments, and related organisations and individuals.

VPMA’s note

An HS code is for export and import. A correct code does not replace a marketing authorisation. A member filing a customs declaration should match the goods to the annex and ask customs when the code does not fit.
