Decree No. 148/2025/NĐ-CP of 12 June 2025, signed by Deputy Prime Minister Nguyen Hoa Binh, takes effect on 1 July 2025. Article 12 assigns new issue, reissue, extension, variation, withdrawal of marketing authorisation, and import permits for household and public-health insecticide and disinfectant products, to the head of the provincial health authority.
Main points
- Article 12, paragraph 1, cites Decree 91/2016/NĐ-CP of 1 July 2016 on management of chemicals and of household and public-health insecticide and disinfectant products, as amended in 2024. The authority sits with the head of the specialised health agency of the provincial People’s Committee.
- Paragraph 2 points the file and the steps to parts 11 to 26 of Annex III: a new authorisation, an extension, a variation for a change of owner of the authorisation number, a change of product name, a change of manufacturing site, a change of name and address of the registrant, a change of use, dose, method of use, active-ingredient content, form, shelf life or source of the active ingredient, reissue of the authorisation certificate, a notice of a label change, import permits (research, aid, gifts, and the case where the market has no suitable product), a certificate of free sale for export, and suspension or withdrawal of the authorisation number.
- Article 34: effect from 1 July 2025. The decree ceases to have effect from 1 March 2027, unless it is extended, or a text adopted or issued from 1 July 2025 and effective before 1 March 2027 covers the same matter, in which case the corresponding part of this decree ceases when that text takes effect. While it is in effect, if it differs from a related text, this decree is followed.
- Article 35: a file submitted before the decree took effect continues to be handled by the office that received it, under the rules then in force, until the procedure ends. The text used here is Official Gazette issues 815 and 816 of 24 June 2025.
VPMA’s note
The decree assigns procedures. It does not set a chemical dose. A member with a file in progress should ask the provincial health authority which part of the annex applies, because Article 34 allows a later text to replace the corresponding part.
